Terms and Conditions
- By using or accessing this website and/or placing any order(s), you agree to be legally bound by these terms and conditions. All other terms and conditions, including those that may be proposed in any order submitted by you, are expressly excluded and shall have no effect.
- Receipt by Ibrowse furniture of an order via our website does not constitute legal acceptance of an order. Your order will be deemed to have been accepted by us only once you have received written confirmation of our acceptance. We reserve the right to refuse your order for any reason we see fit.
- These terms relate to sales over the internet only. Separate terms and conditions apply to purchases made directly from our store.
Payment
- Full payment will be required at time of order.
- All credit and debit card payments are made through a secure e-Payment system. No financial information is kept or stored by our company. If you purchase multiple products on different days you will have to go through the payment process again.
Delivery
- In order to maintain competitive rates, we operate a ONE man delivery service. This means that for bulky, or heavy furniture, you will need to organise some form of assistance at the point of delivery. Due to our insurance terms, our drivers are not allowed to deliver items single-handedly up flights of stairs. However, if assistance is provided by you, our obliging drivers will often help to move items up flights of stairs, but please note that the items are not insured if damaged. A re-delivery charge will apply if we arrive at a destination with a flight of stairs or awkward access and you either refuses delivery, or have not made arrangements to assist the driver. It is illegal for our drivers to stop on a red-route, so you must ensure that alternative arrangements have been made.
- Due to the nature of our insurance, we operate a door-to-door delivery service which means that items are delivered to the threshold of a property. Our friendly drivers will often assist in taking items beyond the threshold, but please note that they are not insured if any damage is caused, and therefore we cannot be held responsible.
- We only guarantee delivery to ground floor. Delivery to any other point is at the discretion of the driver and we do not accept any liability for damages done past this point. It is your responsibility to remove, pictures, soft furnishings, ornaments etc that could be damaged whist delivery is in process. Carpets and rugs should not cause a trip hazards. It is your responsibility to protect your floors and carpets it is not always possible for health and safety reasons for our drivers to remove their footwear.
- Delivery outside the mainland UK will be carried out via an external carrier. All are on a ‘price on application’ basis, and vary depending on the quantity of furniture sent and the method in which we are able to send it. Our order system does not register international postal codes, so you are responsible for obtaining a shipping quote from us prior to placing the order. On deliveries outside the mainland UK, the sales order confirmation page on the website will NOT display the correct shipping cost, the corrected shipping cost will be added prior to the order being despatched. If the exact delivery cost is not known to us prior to despatch, an additional invoice will be raised for the surcharge amount at a later date.
- On receipt of your order into our warehouse, we will contact you to arrange delivery. We will endeavour to fulfil your order by the date set out in the e-mail by which we confirmed your order. All purchases must make allowance of 21 days from the date of dispatch for our delivery team to fulfil delivery to your home.
- Any changes to your order could delay your order we will confirm this by e-mail with a revised delivery time scale.
- You must inspect all products on delivery and advise us of any shortfalls or visible damage, we cannot accept any claim for damage where the product(s) is/are not inspected at the time of delivery. However if your product(s) are delivered by post or courier there may be a small amount of assembly required.
- Orders totalling less than 30kg may be dispatched by post or courier. If this is the case of your order we will confirm this by e-mail.
Access
- It is your responsibility to ensure that the product(s) can be delivered into your home. It is essential therefore that you discuss any possible restrictions on access into your home so that we can perform a risk assessment with you. You should think in particular about vehicle access. If windows or doors need to be removed in order for access to be gained it is your responsibility to arrange this at your cost and risk.
Colours and Finishes
- Photographs displayed on our website and display models and samples in our store are representative of the finished product. Whilst every effort will be made to match all colours and finishes, goods are supplied on the understanding that there may be slight dye, shade and grain variations, particularly with natural products such as wood, leather products are made from quality hides and may not be uniform in colour or texture and will show natural marks and scars.
Size and description of product
- All sizes quoted are approximate. Size and product descriptions are given in good faith from our suppliers’ information. Products are manufactured to perform within the appropriate industry measurement tolerances.
General care
- The product(s) supplied are to be used for the purpose and in the manner for which they were designed. Most manufacturers include care and maintenance advice with their products, which should be read and followed. No responsibility will be accepted for damaged caused by cleaning if the care and maintenance instructions have not been followed.
Amending or cancelling your order
- Made to order products, have been produced specifically for you, therefore no refunds or exchanges can be made after 7 days of placing your order unless there is an error on our part regarding the product specification, or the item is found to be faulty.
- For products ordered over the internet, you have the right to cancel orders on products that are not made to order by notifying us in writing (including e-mail) before delivery or within 14 days of receiving of the goods. N.B. For hygiene reasons mattresses are not covered by our returns policy.
- If you cancel your order once it has been delivered, you must not use the goods, and you must take care of them, and must return the goods in the same condition as received and in the original packaging. Once the goods have been received into our warehouse they will be inspected. You will receive your refund within 30 days of cancellation.
- Please ensure that the goods are maintained in a saleable condition and in their original packaging. Self assembly furniture cannot be returned once assembly is part or fully completed, unless the item is found to be faulty.
- If you do not comply with your obligations above, we will not agree to refund or may make a reasonable charge to cover any costs that we incur (for example in respect of wasted collection journeys or goods that you have damaged or lost). Your statutory rights are not affected.
Cancellations by Ibrowse furniture
- We reserve the right not to accept an order if:
- We do not have the stock to fulfil the order
- We are unable to deliver the products to your area
- An item was incorrectly priced or described on the web site
- Your payment was not authorised
- You have not complied with our terms and conditions
- An order is cancelled by us, any payments made to us will be refunded within 30 days of the cancellation.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
